Take back from the man

You make a fake gun out of trash. You walk into the bank. The fake gun does not set off the metal detector. When you draw the fake gun and demand money the guard knows its a fake gun. But he draws and fires anyway. He shoots you dead with two bullets in the chest. He claims in court he thought it was a real gun and he had to put you down before you hurt somebody. He is cleared of all charges.
