Sneak up behind Sigal and surprise attack

You are sneaking up on that little prick. When you get close enough you are going to punch him in the face full blast and then kick him until something breaks. But sadly, a neighbor is out doing yard work with his .38 strapped to his hip. He has been dreaming of a chance to legally use his gun to kill somebody, a clear cut stand your ground case. He thinks he has it when he sees Sigal pausing to take some cell phone picks of the windows he has broken and you creeping up menacingly at him. He gives no warning, a warning would not allow his kill shot that he has practiced for so long. He waits til you get close enough to strike but as you flail your arm at Sigal a bullet comes from no where. You feel it blast a sizzling hole all the way threw your head!
